Apple vs. Samsung

In recent years there has been a battle. A battle between who has the best and the newest smart phone technology and features. Samsung phones use Android software and Android runs off Google.  Apple is the top dog in this fight. They have the iPhone and all of its versions. Apple is a titan in this industry and about week ago they went to trial to dispute some patent infringements by Samsung.

This technology has been around for years say Apple, but are just now using it in phones. Apple took Samsung to court to file a claim again Samsung for patent infringement. The main feature the case revolved around was the “Pinch Action” to make screens smaller. The court decided that Samsung infringed on this patent on at least 8 different phones and Apple was rewarded 1 billion dollars and some change and a ban on those 8 phones.

Samsung is just a phone. Google provides the operating system that makes Android which Samsung uses. Apple said that Samsung infringed on their patents when in fact it was Google/Android who did so. There is a catch to why Samsung got sued. Samsung is a carrier of Android and is one of the biggest. Google offers this software free to Samsung, LG and more phones but since they GIVE it away there is no money to get from being sued. Google does not make money off of the software. Google makes money off the internet advertising and internet traffic. That is why Samsung was targeted because they use the software on their phones that is the same as iPhones. Google doesn’t profit from any of its software distribution. Apple didn’t sue Google also because Apple uses Google and Google uses Apple and if they both sued each other they both would end up destroying each other. This is why they go after smaller proxies, like Samsung.

I believe that Apple has a right to patent there products and features. I would want to patent something if I created it, if I didn’t everyone else would be entitled to it. Samsung on the other hand is just a phone with a screen that can run the software that Google/Android gives it. Again that software is GIVEN, aka free of charge.  So why would they be sued if they were given to use, something for free in fact and was created by their partner, Google? This case is not over just yet because Samsung said they are going to appeal the outcome of the case which is 1 billion dollars.

What do you think should have been a reasonable outcome of this trial? Do you have a favorite in this argument?
